These Terms of Service (“Terms”) govern your access to and use of thepillowcomfort.com (the “Site”) and any purchases, services, communications, content, features, or other offerings made available through the Site by Moulk Inc., doing business as The Pillow Comfort (“The Pillow Comfort,” “we,” “us,” or “our”).

Please read these Terms carefully before using the Site or placing an order.

By accessing or using the Site, creating an account, submitting information, clicking to accept these Terms where that option is presented, or placing an order through the Site, you agree to be bound by these Terms and the related policies incorporated into them. These Terms form a legally binding agreement between you and Moulk Inc., doing business as The Pillow Comfort. If you do not agree to these Terms, do not access or use the Site or place an order.

The Site is intended for users located in the United States and for orders placed for delivery within the United States unless we expressly state otherwise.

By using the Site, you represent and warrant that:

Moulk Inc., doing business as The Pillow Comfort, operates a pillow and sleep-comfort e-commerce business. We develop and manage The Pillow Comfort brand, define product requirements and specifications, work with third-party suppliers and manufacturers to produce products for our brand, import and store products, and sell them directly to customers through our Site and related sales channels.

Our products may be manufactured by third-party suppliers or manufacturers to our specifications or for our brand. References to The Pillow Comfort products, branding, or product development do not mean that we physically manufacture the products ourselves.

We try to present product descriptions, images, colors, features, specifications, dimensions, and pricing as accurately as reasonably possible. However:

• product images are for illustrative purposes and may vary slightly from the actual product;
• colors and finishes may appear differently depending on your screen or device;
• packaging, included accessories, inserts, and product details may change from time to time;
• product availability is not guaranteed; and
• we reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order is submitted.

We do not guarantee that all products, services, features, or content shown on the Site will always be available.

You may use the Site only for lawful personal, informational, and shopping purposes.

You agree not to:

• use the Site in violation of any law or regulation;
• interfere with or disrupt the Site or any related systems;
• attempt to gain unauthorized access to accounts, systems, or data;

If we offer customer accounts, you are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

• maintain the security of your login credentials; and
• notify us promptly of any unauthorized access to or use of your account.

We reserve the right to suspend or terminate accounts that appear fraudulent, inactive for extended periods, or in violation of these Terms.

A. Order Acceptance

Your order is an offer to purchase. We may accept, reject, limit, or cancel any order in our discretion, including for reasons such as:

• suspected fraud or unauthorized activity;
• errors in pricing, shipping, or product information;
• product unavailability;
• suspected resale or abusive purchasing behavior;
• payment issues; or
• compliance, legal, or operational concerns.

An email confirmation that your order was received does not necessarily mean your order has been accepted. We reserve the right to review and decline orders before shipment.

B. Order Limits

We may limit quantities purchased per person, household, address, account, payment method, or order. We may also refuse orders that appear to be placed by dealers, resellers, distributors, or unauthorized commercial purchasers.

C. Order Changes and Cancellations

Once an order is placed, we cannot guarantee that it can be changed, modified, or canceled. If you need assistance, please contact support as soon as possible. If an order has already entered processing or shipment, changes or cancellation may no longer be possible.

All prices listed on the Site are shown in U.S. dollars unless otherwise stated. Prices, promotions, discounts, bundles, and product availability may change at any time without notice.

You agree to provide current, complete, and accurate billing, shipping, and payment information for all purchases.

We reserve the right to correct pricing errors, typographical errors, or other inaccuracies even after an order has been submitted. If a correction materially affects your order, we may contact you using the information provided or cancel the order and issue a refund if payment was already collected.

Payments are processed through third-party payment providers. By submitting payment information, you represent and warrant that:

• you are authorized to use the payment method provided;
• the payment information submitted is accurate and current; and
• you authorize us and our payment processors to charge the applicable amount for your order, including taxes, shipping charges, and any other disclosed fees.

We do not typically store your full payment card number on our own systems. Payment processing is subject to the terms, conditions, and privacy practices of the applicable payment processor.

We ship to customers in the United States only, unless we expressly state otherwise.

Shipping times, processing times, delivery estimates, and carrier updates shown on the Site, in confirmation emails, or elsewhere are estimates only unless expressly stated otherwise. Actual delivery times may vary based on destination, carrier performance, weather, volume, holidays, security screenings, address issues, and other factors outside our control.

We will maintain a reasonable basis for any shipping timeframe stated on the Site. If we cannot ship within the stated timeframe, or within the period required by applicable law when no timeframe is stated, we will provide any delay notice, cancellation option, consent request, or refund required by law.

We may use carriers such as USPS, UPS, FedEx, DHL, or other delivery providers at our discretion.

You are responsible for providing an accurate and deliverable shipping address. We are not responsible for delivery issues caused by incorrect address information submitted by you.

If a shipment is delayed, lost, marked delivered but not received, refused, returned to sender, or otherwise affected in transit, we will review the circumstances and work with you in good faith, but carrier investigations, delivery confirmations, and claim procedures may apply.

To the extent permitted by applicable law, title to products generally passes to you upon delivery to the shipping address provided in your order, and risk of loss or damage generally passes upon delivery as well.

Nothing in this section limits any non-waivable consumer rights you may have under applicable law.

Returns, refunds, replacements, and any exchange rights are governed by our Refund / Return Policy, which is incorporated into these Terms by reference.

Nothing on the Site should be interpreted as expanding return or refund rights beyond what is expressly stated in the Refund / Return Policy unless we confirm otherwise in writing.

We reserve the right to deny returns, refunds, replacements, or exchanges where permitted by law, including in cases of misuse, abuse of the policy, excessive return activity, damaged or used items inconsistent with our policy, or suspected fraud.

From time to time, we may offer promotions, discount codes, bundles, gifts with purchase, limited-time offers, or other special campaigns.

Unless otherwise stated:

• promotions have no cash value;
• promotions cannot be combined unless expressly permitted;
• promotions may be modified or canceled at any time;
• discount codes may be limited to one per customer, household, or order; and
• if a return reduces the value of your order below a promotional threshold, the related promotion, discount, or gift may be adjusted accordingly.

If you submit or post a review, testimonial, photo, video, comment, suggestion, idea, or other content to us or through the Site (“User Content”), you represent and warrant that:

• you own or control the rights necessary to submit the User Content;
• the User Content is accurate to the best of your knowledge;
• the User Content does not violate any law or third-party rights; and
• the User Content is not defamatory, misleading, obscene, abusive, infringing, or otherwise unlawful.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, publish, display, distribute, and format that content in connection with our business, subject to applicable law. We may make reasonable edits for length, spelling, formatting, or clarity, but we will not materially change the meaning or sentiment of a review or testimonial.

Reviews and testimonials must reflect genuine experiences and honest opinions. We do not permit fake reviews, reviews attributed to nonexistent individuals, or incentives conditioned on expressing a positive or negative opinion. Any material relationship or incentive must be clearly disclosed where required by law.

We are not obligated to post or keep posted any User Content and may remove or decline it at any time.

The Site and its contents, including text, graphics, icons, logos, images, product names, brand elements, designs, layouts, videos, software, code, and other materials, are owned by Moulk Inc., doing business as The Pillow Comfort, or by our affiliates, licensors, suppliers, or content providers, and are protected by intellectual property and unfair competition laws.

Except as expressly permitted, you may not copy, reproduce, modify, distribute, display, publish, republish, transmit, sell, license, create derivative works from, or otherwise exploit any Site content without our prior written consent.

All trademarks, service marks, trade names, logos, and product names appearing on the Site are the property of their respective owners. Use of them without authorization is prohibited.

You are responsible for using products in a safe and appropriate manner and for following any instructions, warnings, care information, packaging directions, and product-specific guidance provided with the product or on the Site.

Our products are intended for lawful consumer use only. They are not intended for any use inconsistent with the instructions, warnings, or ordinary consumer expectations for the product category.

You should stop using a product and contact us if you believe there is a product defect, product safety concern, or material issue affecting use.

Content on the Site is provided for general informational and commercial purposes only. Nothing on the Site is intended as medical, clinical, therapeutic, or other professional advice.

Product descriptions, sleep-position information, comfort guidance, customer experiences, and promotional content should not be interpreted as a promise to relieve pain, correct spinal alignment, prevent snoring, treat a sleep disorder, or produce the same result for every customer.

Our pillows are designed for everyday comfort and support and are not medical devices. Individual comfort and experiences may vary.

This disclaimer does not make unsupported medical claims acceptable elsewhere on the website. Objective health-related claims still require appropriate evidence.

The Site may contain links to third-party websites, apps, platforms, tools, or services, or may integrate features provided by third parties. We do not control and are not responsible for third-party content, terms, privacy practices, products, or services.

Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.

By placing an order, creating an account if available, or contacting us, you agree that we may send necessary transactional and service-related communications by email. These communications may include order confirmations, payment information, customer-support responses, returns, refunds, and delivery-related updates.

If you subscribe to marketing emails, you may receive promotional communications about products, offers, launches, and other brand updates.

You may unsubscribe from marketing emails by using the unsubscribe link included in the message. Opting out of marketing emails will not prevent us from sending necessary transactional or customer-service communications.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOULK INC., DOING BUSINESS AS THE PILLOW COMFORT, AND ITS AFFILIATES, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, LICENSORS, FULFILLMENT PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF GOODWILL, OR INTERRUPTION OF BUSINESS, ARISING OUT OF OR RELATED TO THE SITE, THESE TERMS, OR ANY PURCHASE MADE THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OR ANY PURCHASE MADE THROUGH THE SITE WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM; OR

(B) ONE HUNDRED U.S. DOLLARS ($100).

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Moulk Inc., doing business as The Pillow Comfort, and its affiliates, shareholders, directors, officers, employees, agents, contractors, suppliers, licensors, fulfillment partners, and service providers from and against claims, demands, actions, proceedings, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• your use of the Site;
• your breach of these Terms;
• your violation of any law or third-party rights;
• your User Content; or
• your misuse of products purchased through the Site.

We may suspend, restrict, or terminate your access to the Site, cancel orders, or deactivate accounts at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive conduct, or posed a risk to the Site, our business, or others.

The sections of these Terms that by their nature should survive termination will survive, including sections regarding intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

These Terms and any dispute arising out of or relating to the Site, your use of the Site, or any purchase made through the Site will be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.

Before filing a legal claim, you agree to contact us first at support@thepillowcomfort.com and give us a reasonable opportunity to try to resolve the issue informally.

If a dispute cannot be resolved informally, then, to the extent permitted by applicable law, any action or proceeding arising out of or relating to these Terms, the Site, or any purchase made through the Site shall be brought exclusively in the state courts located in Los Angeles County, California, or the federal courts located in the Central District of California, and you consent to the personal jurisdiction and venue of those courts.

If we fail to enforce any provision of these Terms, that will not be considered a waiver of our right to enforce that provision later.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

These Terms, together with any policies or additional terms expressly incorporated by reference, constitute the entire agreement between you and Moulk Inc., doing business as The Pillow Comfort, regarding the Site and supersede prior or contemporaneous communications, proposals, understandings, and agreements relating to the same subject matter, except for any separate written agreement entered into by an authorized representative of Moulk Inc.

We may update or modify these Terms from time to time in our discretion. When we do, we will post the updated version on this page and update the “Last Updated” date above.

Your continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms, except to the extent applicable law requires additional notice or consent.
